GENERAL CONDITIONS OF SALE

Scope of application
These general terms and conditions of sale are applicable to all commercial relations between customers and the LECQUES AQUANAUT diving center.

Acceptance of the general terms and conditions of sale
By contracting a service with LECQUES AQUANAUT, the customer accepts without reservation these general terms and conditions of sale and declares to have read the contraindications to diving and to be fit to practice it. These contraindications are available at reception.

Medical fitness
The presentation of a certificate of no contraindication to the practice of scuba diving established by a doctor is mandatory for the practice of the activity, except for introductory dives.

Prices
All prices are in euros, including VAT. The applicable rate is the one in effect on the day the customer places the order.

Services
The price of the dive includes boat transport, the dive, the supply of weights and inflation.

Training
The price of the training course includes boat transport, the number of dives planned in the course, inflation, the loan of the necessary diving equipment and certification fees in the event of success.

Diving Cards
Diving cards are nominative and can only be used by one customer. Cards entitle you to a 10% discount for 10-dive cards and 15% for 20-dive cards. Diving cards are valid for 12 months from their issue.

Diving Clubs
The group rate applied to diving clubs is a flat rate calculated on the number of dives booked. Dives not completed due to the client are not deductible from the invoice except for medical reasons .

Reservations
The client's reservation will only be definitively validated upon receipt of a deposit of 20% of the expected amount of the service.

Validity Period
Gift vouchers are valid for one year from the date of issue.
In the event of termination of a course for medical or weather reasons, dives not completed may be postponed within a maximum of one year.

Conditions of practice
Lecques Aquanaut organizes the scuba diving activity under the regulatory conditions in force.
The client undertakes to comply with the regulations as well as the safety instructions given by Lecques Aquanaut.
In the event of non-compliance with the regulations or safety instructions by the client, the activity may be interrupted by the manager of Lecques Aquanaut. In this case, no refund may be claimed from Lecques Aquanaut.

Level Validation
During a training course, if the candidate does not achieve the skills necessary to validate the corresponding level, he or she will not be able to claim any reimbursement.
The manager of Lecques Aquanaut will be the sole judge of his or her decisions regarding the validation or non-validation of skills.

Billing
All reserved services are due unless canceled by Lecques Aquanaut.
In the event that a payment is not honored, the costs related to the management of the unpaid amount will be due by the customer.

Liability
During the activity, customers are covered by civil liability by Lecques Aquanaut.
The client is advised to take out additional individual insurance for the practice of scuba diving.

Dispute – Consumer Mediation
In the event of a dispute between the Customer and the company, they will endeavor to resolve it amicably (the Customer will send a written complaint to the professional or, where applicable, to the professional's Customer Relations Department).
In the absence of an amicable agreement or in the absence of a response from the professional within a reasonable period of one (1) month, the consumer Customer within the meaning of Article L.612-2 of the Consumer Code has the option of contacting, free of charge, if a disagreement persists, the competent mediator registered on the list of mediators established by the Consumer Mediation Evaluation and Control Commission pursuant to Article L.615-1 of the Consumer Code, namely: The Professional Mediation Company http://www.mediateur-consommation-smp.fr Alteritae 5 rue Salvaing 12000 Rodez

Competent Court
In the event of failure of these attempts, any disputes to which these presents may give rise must be brought, even in the event of multiple defendants or a call for guarantee, before the courts within the jurisdiction of the Toulon court.

The applicable law is French law.
